1. Acceptance of Terms

These Terms of Service (hereinafter, the "Terms") constitute a legally binding agreement between you (hereinafter, the "Customer," "User," or "You") and LD Goods and Service LLC, doing business as Legends Divine (hereinafter, "Legends Divine," "Company," "we," "us," or "our"). By accessing or using any services offered by Legends Divine, You acknowledge that You have read, understood, and agree to be bound by these Terms.

2. Business Identity & Contact

2.1 Identity

LD Goods and Service LLC is organized under the laws of the State of Florida, USA, and conducts operations in the United States and Caribbean countries.

2.3 Hours

Monday–Friday: 9:00 AM–5:00 PM (EST); Saturday: 10:00 AM–3:00 PM (EST); closed Sundays and public holidays.

2.4 Notices

We may provide notices (including fee changes and policy updates) via email, WhatsApp broadcast, social media announcements, and conspicuous banners on our website and/or Stan.store page.

3. Eligibility & Accounts

3.1 Age

Services are available only to individuals eighteen (18) years of age or older.

3.2 Verification

Certain services (e.g., mail forwarding) may require completion of USPS Form 1583 and/or presentation of valid government-issued identification.

3.3 Accounts

Accounts may be required for video call shopping, barrel packing, or other designated services.

3.4 Accuracy

The Customer is solely responsible for the accuracy and completeness of all information provided, including names, addresses, customs forms, ID documents, and declarations. The Company shall not be liable for loss, delay, penalty, or other harm arising from inaccurate or incomplete information.

4. Scope of Services

4.1 Services

Without limitation, services may include:

  • U.S. mail and package forwarding
  • Personal/in-store shopping, including video call shopping via WhatsApp
  • Packing and consolidation, including barrel packing
  • Delivery to Caribbean countries

4.2 Operational Role

Legends Divine is not a common carrier; we prepare, pack, and coordinate handover to third-party couriers chosen by the Customer or recommended by us. We may guide Customers to sign up with trusted courier partners; however, carriage is performed by the courier.

4.3 Receipts

Store receipts will be included in the package or shared digitally upon request.

4.4 Video Calls

No refund once video call shopping has commenced; sessions may be rescheduled at our discretion. A service fee may apply to video call shopping.

5. Prohibited & Restricted Items

5.1 Restrictions

Prohibited/restricted items include, without limitation: perishables, aerosols, firearms/ammunition, camouflage apparel, hazardous or dangerous goods, and any items restricted by applicable law or courier policy.

5.2 Inspection

We reserve the right, but not the obligation, to open and inspect packages if fraud, prohibited contents, or safety concerns are suspected. Restricted items may be refused, disposed of, or reported to authorities without liability to Legends Divine.

5.3 Disclosure

A summary of restricted articles is presented on our website and in pre-shipment checks; Customers remain responsible for ensuring compliance.

6. Pricing & Payment

6.1 Currency

Unless otherwise stated, fees for personal shopping, barrel packing, and shipping coordination are quoted and payable in U.S. Dollars (USD) and must be paid upfront before services commence. Upon arrival in Caribbean countries, Customers must pay to collect packages/orders, and any customs duties, storage, processing, and optional door-to-door delivery fees may be payable in local currency or USD, as applicable.

6.2 Payment Methods

All payments are processed securely through Stripe. Accepted methods include credit cards (Visa, Mastercard, American Express, Discover), Stan Store payments, and online checkout for courier services.

Service Fee Policy:

• For Jamaican customers: Service fee is waived when using Legends Divine as your courier; otherwise, the service fee applies.

• For other Caribbean countries: Service fee always applies and is based on shopping budget — see our Stan store or contact us for details.

6.4 Other Fees (Illustrative)

  • Barrel rate: Contact us for pricing (varies by service type)
  • Storage: USD $100/day after a complimentary 14-day holding period
  • Processing fee: USD $200
  • Overweight or customs-related surcharges may apply

6.5 Preauthorization

Preauthorization is required for shipments exceeding specified value/size thresholds or as required by law or courier policy.

6.6 Fee Changes

Fees may be amended at any time; notice will be provided per Section 2.4.

6.7 Pre-Service Payment

All fees—including shopping, packing, and courier drop-off—must be paid in full before services are rendered. Failure to timely pay may result in hold, suspension, storage charges, and eventual disposal under Section 9.

7. Customs & Compliance

7.1 Customer Responsibility

All customs duties, taxes, brokerage, and regulatory assessments are the Customer's responsibility, unless expressly stated otherwise by Legends Divine in writing.

7.2 Guidance Only

We may offer general customs guidance; however, compliance remains the Customer's sole responsibility.

7.3 Documentation

The Customer must provide accurate and complete customs documentation and authorizations when requested.

8. Liability & Insurance

8.1 Return Service Exclusion

Legends Divine does not offer any return shipping service from Caribbean countries (or any destination) back to the United States or to an original seller/supplier. Customers requiring return shipping must arrange their own logistics.

8.2 Risk Transfer

Legends Divine shall be responsible for loss or damage only up to the moment of handover to the designated courier. Upon handover, risk and liability pass to the courier and/or relevant customs authority.

8.3 Delays

We are not responsible for courier or customs delays.

8.4 Claims Period

Claims for loss or damage must be submitted in writing within ten (10) business days of receipt or expected delivery.

8.5 Discretionary Remedies

Refunds or compensation for delayed or lost shipments may be considered case-by-case at our sole discretion.

8.6 Personal Shopping—All Sales Final

Due to the personalized nature of services, all sales are final. If an item is unavailable or out of stock, we will communicate to arrange a suitable replacement.

9. Storage & Disposal

9.1 Complimentary Hold

We will store items without charge for 14 calendar days after arrival.

9.2 Storage Charges

Thereafter, storage accrues at USD $100 per day until collection and full settlement of all amounts due.

9.3 Reminders; Disposal

Reasonable reminders will be sent prior to disposal. Items unclaimed after 30 days may be discarded, donated, or otherwise disposed of at our sole discretion without liability.

9.4 Carrier's Lien

To the fullest extent permitted by law, the Company has a lien on any goods in its possession for all charges, advances, and expenses, including storage and processing fees, and may enforce the lien by sale, donation, or disposal following notice as practicable.

10. Fraud Prevention

10.1 Grounds

We may suspend or terminate services if the Customer:

  • Engages in fraud or suspected fraud
  • Fails to pay fees
  • Attempts to ship restricted items
  • Violates these Terms
  • Provides false or misleading information

10.2 Inspections

We may open and inspect packages where fraud, prohibited items, or safety concerns are suspected.

10.3 Blacklist

We maintain a blacklist to prevent re-registration/re-engagement by Customers terminated for fraud or serious violations. We may notify relevant authorities where required or appropriate.

11. Intellectual Property

11.1 Ownership

All logos, trade names, trademarks, website text and images, designs, and marketing materials are the exclusive property of Legends Divine or its licensors.

11.2 Restrictions

Scraping, framing, copying, reproduction, resale, or other misuse of Company content is strictly prohibited without prior written consent.

11.3 Video Call Content

Legends Divine does not sell or publicly share video call content. Screenshots or recordings (if taken with Customer consent) remain Company property and may be used solely for quality control and fraud prevention.

12. Third-Party Services

12.1 Processors

Payment details are processed securely by Stripe. The Company does not store full payment card details on its systems.

12.2 Couriers

Courier services are provided by independent third parties. Disputes with couriers (e.g., delivery damage, misdelivery) must be handled directly with the courier, unless Company negligence occurred prior to handover.

13. Dispute Resolution

13.1 Tiered Resolution

Any dispute shall first be submitted to good-faith mediation. If unresolved, the dispute may proceed to arbitration or court proceedings as permitted by applicable law.

13.2 Governing Law

(a) For U.S. Customers, these Terms shall be governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

(b) For Caribbean Customers, these Terms shall be governed by the laws of the respective Caribbean country (including, where applicable, local data protection laws).

13.3 Jurisdiction and Venue

Exclusive jurisdiction and venue shall lie in Florida courts for U.S. operations and in the respective Caribbean country courts for Caribbean operations.

14. Modifications

14.1 Right to Amend

Legends Divine may modify or update these Terms at any time.

14.2 Notice of Change

Customers will be notified per Section 2.4. Continued use of services constitutes acceptance of modified Terms.

15. Disclaimers & Limitations

15.1 No Warranty

Services are provided "as is" and "as available," without any express or implied warranty, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.

15.2 Insurance Disclaimer

All shipments coordinated, packed, or forwarded by Legends Divine are done so at the Customer's risk. Shipments are not insured by Legends Divine, and the Company shall not be liable for loss, damage, or delay once a package is transferred to a courier or customs authority. Customers may procure insurance independently through the courier or third-party providers.

15.3 Indirect/Consequential Damages

To the maximum extent permitted by law, Legends Divine shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, revenue, or data.

15.4 Aggregate Cap

To the extent liability is not disclaimed, aggregate liability shall not exceed amounts actually paid by the Customer for the specific service giving rise to the claim.

16. Privacy and Data

16.1 Collection

Personal information may include, without limitation: name, first and last names, phone number, tax ID (TRN), email, street address, suite/unit info, city/town, country, state/province, postal code, billing/shipping addresses, WhatsApp messages, video call data, and payment confirmation.

16.2 Storage & Use

Customer chats, screenshots, and video logs may be stored for fraud prevention, quality control, or dispute resolution.

16.3 Third Parties

Data is shared only with couriers, customs brokers, and payment processors for service fulfillment or legal compliance.

16.4 Deletion/Opt-Out

Customers may request deletion of personal data via email or WhatsApp. We assume consent for communications unless the Customer unsubscribes.

16.5 Hosting

The website is self-hosted on servers located in the United States.

17. Children's Policy

17.1 Legends Divine does not knowingly collect information from individuals under 16 years of age.

17.2 Age is verified at account registration and during video call sessions.

17.3 If underage data is discovered, it will be deleted immediately.

18. General Provisions

18.1 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.2 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to an affiliate or successor.

18.3 Entire Agreement

These Terms constitute the entire agreement between You and the Company with respect to the subject matter hereof and supersede all prior or contemporaneous understandings or agreements.
